features were not included as advertised, how to deal with this issue?

I got this message from Dell a few days ago and today also.

  2. Energy Star 8.0

when I contacted them to resolve the issue, their answer was, 

The delivery date has already exceeded 10 days for the relevant order, so it seems difficult to return the product.

any idea how to deal with this issue ??
