Cisco Code upgrade
We wish to upgrade our SAN OS from 3.3 to the nexus code so we can support the new 8GB line cards we bought.
We are being told that we will have to reboot the switches before we can start using the new line cards after the code upgrade.
I want to know if there is a way around this?

Looks like it does actually need a reload. Take a look at this doc, http://www.cisco.com/en/US/docs/switches/datacenter/mds9000/hw/9500series/installation/guide/installmigratefab2.html
Here's part of the text under the Overview section:
The MDS 9513 Director requires a reload after both Cisco MDS NX-OS Release 4.1(1b) or later and the MDS 9513 Fabric 2 modules are installed in order for the MDS 9000 48-port 8-Gbps Fibre Channel module and the MDS 9000 24-port 8-Gbps Fibre Channel module to power up.

Man.. That is really bad for us as some of our systems are single path'ed and there is no plan to multipath them.
We can not such an intrusive outage

With 2 supervisors in each chassis I don't see a reason why you would need to reboot the switch to complete an upgrade. You may need multiple upgrades depending on what version of NX-OS code you plan to go to. It will give you the upgrade path from your version in the release notes: http://www.cisco.com/en/US/products/ps5989/prod_release_notes_list.html
