Your privacy is important to us. This Privacy Statement explains how Dell Canada Inc. and its Canadian Affiliates* (“Dell”, “we” or “our”) and our affiliated companies (unless they have published their own privacy statement), collect, process, use, protect, and share your personal information as well as outlines your privacy rights under applicable privacy laws.

This Privacy Statement governs Personal Information we collect from our customers and online users ("you"), as well as information we automatically collect from your online visits (e.g. data collected via cookies). For the purposes of this Privacy Statement, "Business Partner" means any subcontractor, vendor or other entity with whom we have an ongoing business relationship to provide products, services or information. We use your personal information to provide you with our products and services, improve our products and services, tailor your customer experience with Dell, personalize our products and services and make recommendations to you, advertise and market to you, and to comply with applicable laws. We also use your information to improve the safety and security of our website, products, and services, which includes detecting, preventing investigating, and responding to risks in these areas that could harm you or Dell.

We may share your personal information with our affiliated companies and Business Partners to perform work for us, including completing any transaction, providing you with the latest information about our products, services, or offering you our latest promotions. When we share your personal information with a Business Partner, we require them to protect it and allow them only to use it for purposes Dell allows.

When you permit us to, we may disclose your Personal Information to credit bureaus and credit reporting agencies and financial institutions and to other third parties as necessary to obtain and maintain your credit history, provide credit references, process payments, and otherwise manage our accounts and fulfill our legal and regulatory requirements. There are some rare cases where we disclose your personal information without your consent, such as when we are ordered by a court or regulatory body to do so or we receive a search warrant.

Changes To This Privacy Statement

We may make changes to this Privacy Statement when necessary to provide greater transparency or in response to:

Information We Collect About You

"Personal Information" means information about you, or that can be used to identify you.

The types of information we collect about you depends on your use of our products, services, and the ways that you interact with us.  This may include information such as:
  • How you use or visit our websites, accounts with Dell, or applications.
  • How you use our services and products and interact with us.
  • Contact, billing, and other information you provide.
  • Information to improve and develop our products and services.
  • Information that allows us to personalize our products and services and make recommendations.
  • Information we use to advertise and market to you, which includes sending promotional communications, targeting advertising, and presenting you with relevant offers.
We also obtain information from third-party sources. We protect information obtained from third-parties according to the privacy practices as described in this Privacy Statement.  These third-party sources vary over time and may include:
  • Data brokers from which we purchase demographic data to supplement the information we have collected about you.
  • Communication services, including email providers and social networks, when you give permission to access your information on such third-party services or networks.
  • Partners with which we offer co-branded products or services, or engage in joint marketing activities.
  • Publicly available sources, such as open government databases.
The personal information we collect can include the following:
  • Contact details such as your name, email address, mailing address, contact telephone numbers.
  • Employment information such as your job title and other business or company information.
  • Credentials such as your passwords, password hints, and similar security information used for authentication and My Account access.
  • Demographic information such as your age, gender, country, interests, and preferences.
  • Web form information you provide in our web forms (forms that you choose to complete will indicate whether the information requested is mandatory or voluntary).
  • Payment information to process payments, such as your payment instrument number (such as a credit card number) and the security code associated with your payment instrument.
  • Account history information related to the products or services you purchase, and the activities associated with your account.
  • Cookie and tracking information such as IP address, device identifier, location data, browser type and language, access times, the Uniform Resource Locator (URL), other unique identifiers, and other technical data that may uniquely identify your device, system or browser.
  • Error reports and performance information of the products and any problems you experience, including error reports.
  • Troubleshooting and help information when you contact Dell to make a purchase or for technical support or customer support services, phone conversations, or chat sessions with our representatives which may be monitored and recorded.
  • Content consumption information about media content (e.g. T.V., apps, and games) you access through our products.
  • Feedback and rating information you provide to us such as customer survey feedback and product reviews you write.
  • COVID-19 health and vaccination status and thermal temperature readings (as permitted by applicable law or in compliance with applicable public health directives).
  • Workspace location information.
We may also ask for your Social Insurance Number (SIN) and other data to process your credit or financing request. Providing your SIN assists with the accurate processing of your application. However, providing your SIN is optional and choosing not to provide it will not prevent you from obtaining credit or other products or services from us. When you are a credit or leasing customer, we collect information about your transactions, including your purchases, account balances and payments.

Job applicants may be asked to provide information such as educational background, employment experience and job interest, and such information may be recorded and processed in different countries. We may also collect demographic information, such as your business or company information, age, gender, interests, and preferences. Forms that you choose to complete will indicate whether information requested is mandatory or voluntary.

We may collect information about your visits to our websites, including the pages you view, the links and advertisements you click, search terms you enter, and other actions you take in connection with Dell websites and services. We may also collect certain information from the browser you use to visit our websites, such as your Internet Protocol (IP) address, browser type and language, access times, the Uniform Resource Locator (URL) of the website that referred you to our websites and any URLs you select on our websites.

In order to offer you a more consistent and personalized experience in your interactions with Dell, information collected through one source may be combined with information Dell obtains through other sources. We may also supplement the information we collect with information obtained from other parties, including our Business Partners and other third parties.

Some Dell services may be co-branded and offered in conjunction with another company. If you register for or use such services, both Dell and the other company may receive information collected in conjunction with the co-branded services, and may use the information according to each company's privacy statement and other agreements with you.

COVID-19 Health Survey Tools, Thermal Vision Camera and COVID Self-Reporting

In order to help reduce the risk of COVID-19 infections and keep our communities safe, all Dell employees, contingent workers, and visitors may be asked to complete a COVID-19 health and vaccine survey, attest to their COVID-19 vaccine immunization status and/or COVID-19 negative test results, and/or pass a thermal body temperature screening in order to gain access to Dell premises. The thermal vision camera measures your body temperature on an anonymous basis and Dell does not retain your body temperature. If your body temperature is equal to or above 100.4 degrees Fahrenheit, you will be denied entry and/or asked to leave Dell premises.

The COVID-19 health and vaccine survey collects your name, email address, Dell badge number, work location, COVID-19 vaccination status and limited health data you voluntarily provide. The COVID Self-Report voluntary reporting tool collects your name, email address, Dell badge number, work location, phone number and limited health data you voluntarily provide. Subject to local laws, we will collect proof of your COVID-19:

(a) Vaccine immunization status certificate issued by the local government authority, including digital certificates issued by the local government authority (e.g., COVID-19 digital certificate), or
(b) Negative COVID-19 screening test result including:
  • your first and last name
  • specimen collection and negative test result dates
  • the entity issuing the COVID-19 negative test result

How We Use Personal Information

Dell uses your Personal Information to:
  • Deliver the services and support or carry out the transactions you have requested;
  • Send communications to you, such as product safety information, your transaction status including order confirmations, information about particular Dell programs in which you have chosen to participate, information about products and services available from Dell and its Canadian Affiliates, promotional offers and surveys;
  • Facilitate communications from Dell Business Partners;
  • Customize, analyze and improve our products, services (including the content and advertisements on our website), technologies, communications and relationship with you;
  • Generate insights about our business, by de-identifying it and/or combining with other information in aggregate;
  • Enforce our conditions of sale, website terms and/or separate contracts (if applicable) with you;
  • Identify patterns of behaviour to offer relevant suggestions to users. For example, based on data collected through cookies on our website, we may be able to determine that users who viewed certain products may also like other specific products. These cookies are not tied to personal identifiers;
  • Meet our legal and regulatory requirements;
  • Detect, suppress or prevent fraud and other prohibited or illegal activities;
  • Authenticate you;
  • Protect the security or integrity of our website(s), our business(es), or our products or services;
  • Promote the overall health and safety of the workplace, including to help reduce the risk of COVID-19 infections at Dell premises.
  • Otherwise, as disclosed to you at the point of collection.

Personal Information collected may be stored and processed in the United States or any other country in which Dell or Dell Inc. or its subsidiaries or Business Partners maintain facilities.

How we Share or Disclose Personal Information

We may share your Personal Information with Dell, Dell Inc., or its subsidiaries or Business Partners to carry out transactions you request, or to make our business or that of our subsidiaries more responsive to your needs, including by having our Canadian affiliates provide you with information about Dell, and Dell-branded products and services. These communications may include requests relating to Dell and Dell-branded products or services or offers. We will only share your Personal Information with Business Partners who agree to protect your Personal Information and use it solely for the purposes set forth by Dell.

In addition, Dell may share your Personal Information with participants in our sales and marketing chain, including but not limited to retailers, resellers, distributors, integrators, order fulfillers and some sales agents ("Channel Partners"), for the limited purposes of selling, marketing or providing support for Dell products and services.

We may transfer your Personal Information to Business Partners that help Dell carry out transactions you request, that help Dell promote and market additional goods, services and special offers from us and/or our Canadian Affiliates, or that help Dell to customize, analyze, and/or improve our communication or relationship with you, and then only with Service Providers who share Dell's commitment to protecting your Personal Information. For example, Dell may use Business Partners to deliver email to Dell customers, may work with Service Providers to customize ads based on pages users visit on Dell.com (including Dell.ca), or may allow Business Partners to collect aggregate information to identify trends and analyze which pages are visited most often by visitors to Dell.com. Dell may disclose Personal Information to Business Partners to complete transactions or market on Dell's behalf, but those Business Partners are prohibited from using your Personal Information for their own purposes.

Some Business Partners are located outside of Canada, including in the United States. Likewise, some Dell facilities may also be located outside of Canada. As a result, your Personal Information may be collected, processed and stored in another jurisdiction. Reasonable contractual and other measures we may take to protect your Personal Information while processed or handled by these Business Partners are subject to legal requirements applicable to our Business Partners; for example, lawful requirements to disclose Personal Information to government authorities in certain circumstances.

We may disclose your Personal Information to credit bureaus and credit reporting agencies and financial institutions and to other third parties as necessary to obtain and maintain your credit history, provide credit references, process payments, and otherwise manage our accounts and fulfill our legal and regulatory requirements.

We and our service providers may provide your personal information if we have a good faith belief that such disclosure is necessary in response to a search warrant or other legally valid inquiry or order, or to another organization for the purposes of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud, or as otherwise may be required or permitted by applicable Canadian, U.S. or other law or legal process, which may include lawful access by U.S. or foreign courts, law enforcement or other government authorities. Your personal information may also be disclosed where necessary for the establishment, exercise or defence of legal claims and to investigate or prevent actual or suspected loss or harm to persons or property.

Except as described above, we will not disclose your Personal Information to third parties for their own marketing purposes without your consent.

Your Consumer Privacy Rights

You have the following consumer privacy rights under applicable laws:

Right to Know: you have the right to request information about the personal information we have collected about you and for what purpose.
Right to Access and Rectification: you have the right to request access to your information and request that your information be corrected or amended and to obtain a copy of that personal information.
Right to Be Free from Discrimination: Dell will not discriminate against you for exercising your consumer privacy rights.
Right to Withdraw your Consent: you have the right to withdraw your consent to having your personal information processed. Consent may be withdrawn at any time, subject to legal or contractual restrictions and reasonable notice. Depending on the circumstances, however, any withdrawal or amendment to your consent may prevent us from providing you, or continuing to provide you, with Dell’s products and services or information that may be of value to you.

How You Can Access Your Information

Dell wants to help you keep your Personal Information accurate. To view or edit your Personal Information that has been stored online in your Dell account, please visit the My Account or Premier Account sections of the Dell.ca website. For the security of your account, you will be required to sign in with your login ID and password. If you have any questions about the type of Personal Information we hold about you or, where required by law, if you wish to request access or correction of other Personal Information we hold about you, please send a written request to privacy@dell.com or the postal address provided at the bottom of this Privacy Statement.

We may ask you for information to confirm your identity before we provide you with access to information or to amend information. In each such case, you must clearly indicate the information that you wish to have access to, or wish to have amended. If you successfully demonstrate that the personal information we have for you is inaccurate or incomplete, we will amend our records of your personal information as required.

Note that despite any request for a change to or removal of your personal information, we may need to retain certain information for recordkeeping purposes, and there may also be residual information that will remain within our databases and other records, which will not be removed or changed.

We may make commercially reasonable efforts to transmit any amended information to third parties having access to your personal information, where necessary in the circumstances.

Selecting Your Communication Preferences and Opting Out of Marketing

You may choose to receive or not receive marketing communications from Dell by indicating your preferences. Opportunities to select your preferences include the following:
  • The My Account and Premier Account sections on Dell.com allow you to choose whether you wish to receive marketing communications from Dell, and to subscribe or unsubscribe to newsletters about our products and services;
  • At any point you may also visit our List Removal Page and submit a request to be removed from our advertising and marketing lists (catalogs, telephone, faxes and email);
  • When you save a cart while shopping online, you may choose to receive email reminders; and
  • Any marketing by Dell, or any third parties on behalf of Dell, will be conducted in accordance with applicable laws and include, where applicable, methods to allow you to express your preferences.

Please allow up to 10 business days for your email preferences to take effect. Because some promotions, such as direct mail catalogs, are developed in advance, you may sometimes receive solicitations after we receive your preference request.

Dell has retention standards for customer information and records management which set out these timelines. We have retention policies in place that govern the destruction of Personal Information.

How We Secure Your Personal Information

We use appropriate technical, organizational, and physical data security safeguards to help protect against unauthorized access to, use, or disclosure of information we collect, use, or store. The ways we do this include:
  • Using encryption when collecting or transferring sensitive information, such as credit card details;
  • Design our data security safeguards to ensure the ongoing security, integrity, availability, and resilience of processing systems and services.
  • Limiting physical access to our premises;
  • Limiting access to the information we collect about you; and
  • Ensuring that our Business Partners have appropriate technical and organizational security measures to keep your personal information protected.
  • As required by law, destroying or de-identifying personal information.
We encourage you to keep any passwords you use confidential and to be careful to avoid “phishing” scams where someone may send you an email that appears to be from Dell asking for your personal information.  Dell will not request your ID or password through email.

Collection and Use of Children's Personal Information

We understand the importance of taking extra precautions to protect the privacy and safety of children using our products, services, and our websites.  Children under the age of 13 or equivalent minimum age in the relevant jurisdiction, must not share their personal information unless their parent or guardian provided verifiable consent.  If at any time a parent or guardian needs to access or delete data associated with their child’s or guardian’s account, they may contact us through one of the options provided in this Privacy Statement.

How We and Our Partners Use Cookies

Dell websites use Dell and third-party "cookies" to enable you to sign in to our services and to help personalize your online experience. We use cookies to store your preferences and other information on your computer in order to save you time by eliminating the need to enter the same information repeatedly.

A cookie is a piece of text that is placed on your computer's hard drive. Depending on the settings you have selected, your browser adds the text to your device as a small file. Many browsers are set to accept cookies by default. You have the ability to accept or decline cookies as you prefer. The Help portion of your web browser, most likely found on the toolbar, typically tells you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether.

Cookies allow you to take advantage of some of Dell's essential features, including allowing you to save a Shopping Cart and remembering items in your Shopping Cart between visits. If you choose to decline cookies, you may not be able to sign in or use other interactive features of Dell websites and services that depend on cookies.

Targeted Display Advertising by Dell and Others

Dell also works with advertising and personalization Business Partners that use cookies to help us display personalized content and appropriate advertising during your visits to Dell.ca and other websites based on your visits to Dell.ca. Cookies placed by these Business Partners also assist us with measuring the performance of our advertising campaigns and with identifying the pages you view, the links and ads you click on, other actions you take on those web pages, and the site from which you came before arriving at a web page. These cookies can be effective whether you are on Dell.ca or another website.

For example, Dell may collect data on which pages you visit on the website and later combine this information on purchases you complete on Dell.ca. We and our Business Partners may use the combined data to determine which ads to serve you on Dell.ca or third party websites or to determine what marketing communications to send you in the future.

“Do Not Track” Signals

Please note that while you may have the opportunity to opt-out of targeted advertising through the “Learn more” link above and you may be able to control the use of cookies through your web browser as described in the “How We and Our Partners Use Cookies” section above, some web browsers may also give you the ability to enable a “do not track” setting. This setting sends a special signal to the websites you encounter while web browsing. This “do not track” signal is different from disabling certain forms of tracking by declining cookies in your browser settings, as browsers with the “do not track” setting enabled still have the ability to accept cookies. Dell does not respond to web browser “do not track” signals at this time. If we do so in the future, we will describe how we do so in this Privacy Statement. Targeted Email Marketing by Dell

Some marketing you receive, including email marketing, may also be personalized based on your visits to Dell.ca and your browsing and purchase history. In addition, when you click on some links in email marketing you receive, our email service provider may place a cookie on your browser. This type of cookie would be linked to your email address or IP address and used to gather information about the products and services you view and purchase on Dell.ca. Information gathered may be used to personalize and customize future email marketing messages you receive. You may opt out of this use by clicking on the unsubscribe link provided in every personalized email marketing message you receive.

How We and Our Partners Use Web Beacons, Pixel Tags and Tracking Technology

Dell or its Business Partners may use web beacons on our websites, in our email messages, in our advertisements on other websites, or in our advertisements in others' email messages. Similarly, third parties whose content or advertisements appear at Dell.ca, or whose email messages Dell.ca sends to our users, may also place web beacons in their advertisements or email messages for purposes of measuring the effectiveness of the content, advertisements or email messages.

A web beacon is an electronic image that can be used to recognize a cookie on your computer when you view a web page or email message. Web beacons help us measure the effectiveness of our website and our advertising in various ways. For example, web beacons may count the number of individuals who visit our website from a particular advertisement or who make a purchase from our website after viewing a particular advertisement or they may tell us when a web page is viewed and provide a description of the page where the web beacon is placed. Web beacons may also measure the effectiveness of our email campaigns, by counting the number of individuals who open or act upon an email message, determining when an email message is opened and determining how many times an email message is forwarded. We may combine the information that we collect through web beacons with other Personal Information we have collected from you.

We may allow some of our Business Partners to compile individual or aggregated statistics from the use of web beacons on Dell.com by Dell, its agents or others, to determine the effectiveness of online marketing and to develop statistics on how often clicking on an advertisement results in a purchase or other action on the advertiser's site. Aggregate information may include demographic and usage information. No Personal Information about you is shared with Business Partners for this research.

You can make some web beacons unusable by rejecting cookies in your web browser as described in the How We and Our Partners Use Cookies section above.

When you visit our websites or view one of our email messages, we may use pixel tags (also called "clear" gifs), tracking links and/or similar technology to note some of the pages you visit on our websites. We may also use pixel tags to determine what types of email your browser supports. We may use the information collected through web beacons, pixel tags, tracking links and similar technology in combination with your Personal Information to personalize your experience on Dell.com and to provide you with more useful and relevant advertisements.

Social Media Features

Our website includes social media features, including Facebook “Like” button and Twitter “Follow” button. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. Social media features are either hosted by a third party or hosted directly on our website. Your interactions with these features are governed by the privacy policy of the company providing it.

Links to Third-Party Websites and Services

We may sometimes provide links to other websites, which if you click on them may collect personal information about you and direct you to those websites. The information practices of those third-party websites linked to our website are covered by the third party's' own privacy statements and we encourage you to read those.
